Digressioni sul tema di Rent to buy a partire dal Tribunale di Verona, 12 dicembre 2014, n.95

The first jurisprudential order on the new rent-to-buy contract, issued by the court of Vero- na on 12th December 2014, n. 95, allows a reflection on this type of agreement. This contract – which allows a party to immediately use a building, and afterwards make a decision on the purchase using some of the money already paid - is analysed, in its structure, comparing it to the legal instruments used before its introduction. Through this analysis, it can be inferred that this contract is only for- mally recognised by the law, but not strictly codified in its content, allowing the parties involved to have considerable contractual freedom. Therefore, it may efficiently be used in B2B negotiations.
