The issue is addressed to the case of loans granted by INPS. The work proposes an analysis of the Italian regulation of land credit (“credito fondiario”) with reference to the possibility of extending it to mortgages with the same characteristics, but not granted by banks as contemplated by art. 40 t.u.b. Subsequently, the vocation opened up by the aforementioned rule is assessed. Finally, the analysis turns to the contractual autonomy of the parties in the provision of an express termination clause, notwithstanding the legislator’s intention to include protection for the consumer.

Abstract
